Without a court order that, legally, the answer is no, especially since it is not worthwhile for children and the child could see through the courts. Split custody is a legal term, physical custody. You are in these roles today, but at all times, the father of her child may request that the court issue an order granting joint custody or sole custody of the child. I doubt that to what you said would happen to base, but it is legally impossible.
